Special Use Airspace

What makes airspace special use

The opening lesson of this unit divided the National Airspace System (NAS) into four types: controlled airspace, uncontrolled airspace, special use airspace, and other airspace. The two lessons since then took the first two. This lesson takes the third.

Special use airspace consists of airspace of defined dimensions identified by an area on the surface of the earth wherein activities must be confined because of their nature, or wherein limitations are imposed upon aircraft operations that are not a part of those activities, or both (14 CFR 73.3(a)).

A special use airspace designation does not replace the class of the airspace it occupies. Inside a restricted area you are still in whatever class of airspace applies there, and that class's weather, radio, and equipment requirements apply unchanged. The designation adds a further condition on top of them.

Special use airspace usually consists of six kinds of area (PHAK Chapter 15). They are:

Regulatory and nonregulatory

14 CFR part 73 designates special use airspace, and it reaches exactly two of the six kinds: subpart B designates restricted areas and subpart C designates prohibited areas (14 CFR 73.1). Those two are regulatory special use airspace, established through the rulemaking process. Warning areas, MOAs, alert areas, and CFAs are nonregulatory special use airspace (AIM 3-4-1).

No person may operate an aircraft within a restricted area contrary to the restrictions imposed, or within a prohibited area, unless that person has the permission of the using or controlling agency, as appropriate (14 CFR 91.133(a)). Entering either without that permission is a violation of the regulations, separately from any hazard met inside.

No regulation prohibits your entry into a warning area, a military operations area, an alert area, or a controlled firing area, and none requires you to obtain permission before you fly into one. Each of those four is designated because of the activity conducted inside it rather than to place a condition on your entry.

Prohibited, restricted, and warning areas share one boundary symbol, drawn in blue. Alert areas and military operations areas share a second, drawn in magenta. The designation tells you which of those two you are looking at: a letter and a number for an alert area, a name followed by MOA for a military operations area. In the symbology of the FAA Aeronautical Chart Users' Guide each boundary is a line carrying a band of short ticks turned inward, toward the designated airspace. Each designation is lettered in the color of its own band.

What the table's third column does not tell you The third column states what the regulations demand, not what the airspace contains. A warning area over the water can hold the same live gunnery as a restricted area over land. What differs is jurisdiction: the United States government does not have sole jurisdiction over the airspace a warning area occupies (PHAK Chapter 15).

Prohibited areas

A prohibited area contains airspace of defined dimensions within which the flight of aircraft is prohibited. Such areas are established for security or other reasons associated with the national welfare (AIM 3-4-2). No person may operate an aircraft within a prohibited area unless authorization has been granted by the using agency (14 CFR 73.83).

The chart prints the letter P and a number. Eleven prohibited areas are designated in the United States. P-40 lies over Camp David in Maryland, designated from the surface up to but not including 5,000 feet MSL. P-56 lies over the District of Columbia in two separate sub-areas, each from the surface up to and including 18,000 feet MSL. Both are in effect continuously.

The using agency for a prohibited area is the agency, organization, or military command that established the requirements for the area (14 CFR 73.85). Part 73 gives no FAA facility the power to grant an authorization for a prohibited area. In the chart tabulation a prohibited area's row prints NO A/G in the CONTROLLING AGENCY/CONTACT FACILITY column, the abbreviation for no air to ground communications. A note on the tabulation sends you to a flight service station for information about the area. A flight service station is an air traffic facility that gives pilots preflight briefings and en route information by radio and telephone.

Restricted areas

A restricted area contains airspace within which the flight of aircraft, while not wholly prohibited, is subject to restrictions. Restricted areas denote the existence of unusual, often invisible, hazards to aircraft, such as artillery firing, aerial gunnery, or guided missiles. Penetrating one without authorization from the using or controlling agency may be extremely hazardous to the aircraft and its occupants (AIM 3-4-3).

The prohibition in the regulation carries two qualifiers. No person may operate an aircraft within a restricted area between the designated altitudes and during the time of designation, unless that person has the advance permission of the using agency described in 14 CFR 73.15 or the controlling agency described in 14 CFR 73.17 (14 CFR 73.13). Above the ceiling, below the floor, or outside the published hours, the area imposes no condition on your flight.

The chart prints the letter R and a number, in blue. Where an IFR route crosses a restricted area released for joint use, instrument flights may be authorized to transit it and are routed accordingly (AIM 3-4-3).

Using agency and controlling agency

14 CFR 73.13 names two authorities whose advance permission lets you into a restricted area.

The using agency is the agency, organization, or military command whose activity within the restricted area necessitated the area being so designated (14 CFR 73.15(a)). Three duties follow (14 CFR 73.15(c)):

The controlling agency is the FAA facility that may authorize transit through or flight within a restricted area in accordance with a joint-use letter (14 CFR 73.17). An air traffic control (ATC) facility holds that role, usually an air route traffic control center (ARTCC). Upon the FAA's request the using agency executes a letter establishing procedures for joint use of the area, under which it notifies the controlling agency whenever that agency may grant permission for transit through the area (14 CFR 73.15(b)).

You can request the status of an area from either agency. The chart tabulates the controlling agency's frequency in its margin (AIM 3-4-9). You reach the using agency before the flight rather than from the cockpit.

Warning areas

A warning area is airspace of defined dimensions, extending from three nautical miles outward from the coast of the United States, that contains activity that may be hazardous to nonparticipating aircraft. The purpose of such areas is to warn nonparticipating pilots of the potential danger. A warning area may be located over domestic or international waters or both (AIM 3-4-4).

The chart prints the letter W and a number, in blue. No regulation conditions your entry. The tabulation still gives the area's altitudes, its hours, and its controlling agency frequency.

Military operations areas

An MOA consists of airspace of defined vertical and lateral limits established for the purpose of separating certain military training activities from IFR traffic. Whenever an MOA is being used, nonparticipating instrument flight rules (IFR) traffic may be cleared through it if IFR separation can be provided, and is otherwise rerouted or restricted (AIM 3-4-5). Nothing in that arrangement applies to a visual flight rules (VFR) flight, which may enter an active MOA legally and without asking anyone.

Examples of activities conducted in MOAs include air combat tactics, air intercepts, aerobatics, formation training, and low-altitude tactics (AIM 3-4-5). Two provisions that would otherwise constrain that flying are lifted inside an active MOA:

The airplane you meet in an active MOA may therefore be maneuvering abruptly and faster than 250 knots at an altitude where you are held to 250. AIM 3-4-5 asks for two calls. They are:

What the speed exemption costs you A military airplane at 450 knots and your trainer at 100 knots, converging head on, close at 550 knots. That is one nautical mile every 6.5 seconds. Your duty to see and avoid other aircraft under 14 CFR 91.113(b) does not change inside an MOA.

Alert areas and controlled firing areas

An alert area is depicted on aeronautical charts to inform nonparticipating pilots of areas that may contain a high volume of pilot training or an unusual type of aerial activity (AIM 3-4-6). All activity within an alert area must be conducted in accordance with the regulations, without waiver. Pilots of participating aircraft, as well as pilots transiting the area, must be equally responsible for collision avoidance.

The chart prints the letter A and a number, in magenta. In large areas the type of area is spelled out as well where space permits. Alert areas do not extend into Class A, Class B, Class C, or Class D airspace, or into Class E airport surface areas (FAA Aeronautical Chart Users' Guide).

A controlled firing area contains activities that, if not conducted in a controlled environment, could be hazardous to nonparticipating aircraft. Its distinguishing feature, compared with every other kind of special use airspace, is that its activities are suspended immediately when spotter aircraft, radar, or ground lookout positions indicate an aircraft might be approaching the area (AIM 3-4-7).

A controlled firing area is therefore not drawn on any chart. The activity stops when you approach, so the area never causes a nonparticipating aircraft to change its flight path. There is nothing left for the chart to warn you about (AIM 3-4-7; FAA Aeronautical Chart Users' Guide).

Reading altitudes, hours, and the frequency to call

Every permanent special use airspace area except a controlled firing area is charted (AIM 3-4-1). On the map face the chart gives an area's type and its identifying name or number, positioned within or immediately adjacent to the area (FAA Aeronautical Chart Users' Guide). Its altitudes, its hours, its controlling agency, and the frequency to call sit in a tabulation printed in the chart margin.

Areas are shown in their entirety within the limits of the chart, even when they overlap, adjoin, or when one is designated within another (FAA Aeronautical Chart Users' Guide).

Six printed notes govern how the numbers are read:

In the last of those notes, DoD is the Department of Defense. The second of them restates a regulation: unless otherwise specified, the word "to" an altitude or flight level means "to and including" that altitude or flight level (14 CFR 73.3(b)). A ceiling written TO 6000 includes 6,000 feet MSL, so an airplane level at exactly 6,000 feet is inside the area.

Take R-2506, the area drawn on the map face earlier in this lesson. Its row is the fifth in the strip above: TO 6000, SR-SS MON-FRI, JOSHUA CON FAC, 120.25 133.65. Read against the panel notes, that row gives four things:

Crossing that area at 8,500 feet MSL on a Tuesday afternoon requires nothing of you, because you are 2,500 feet above the ceiling. Crossing it at 5,500 feet in the same hour requires the advance permission of the using agency or of the Joshua Control Facility.

The chart does not give you three things. A preflight has to establish each of them:

Go deeper (primary source): read 14 CFR part 73 end to end and notice that 73.13 and 73.83 are each a single sentence. Then read AIM Section 3-4 from 3-4-1 through 3-4-7 and mark which paragraphs cite a regulation and which do not.
